Apple’s Allegations: How Former Employees Took Secrets
Chang Liu, who spent eight years at Apple, resigned in January 2026 but failed to return his work laptop. He then exploited an authorization vulnerability to access internal networks after leaving. According to the lawsuit, he downloaded dozens of confidential files, including presentations on unreleased products, engineering documentation, and supply chain data. Apple also claims Liu recruited at least one other employee who participated in the data theft.
Tang Yu Tan, who spent 24 years at Apple–including as vice president of iPhone and Apple Watch design–is now OpenAI’s head of hardware. The lawsuit alleges Tan participated in hiring former Apple employees for OpenAI, questioned them about Apple’s work, and welcomed the theft of trade secrets. Candidates were reportedly asked to bring “factual details” and “demonstrate prototypes” during interviews.
According to Apple, OpenAI’s hardware division has hired more than 400 former Apple employees. The lawsuit follows OpenAI’s May 2025 acquisition of io Products, founded by former Apple design chief Jony Ive. The stolen data includes design, metal processing, batteries, displays, and power management chips.
Apple is seeking an injunction, return of devices and documentation, and unspecified damages.

Context: Failed Partnership and OpenAI’s Smartphone Plans
The conflict comes after a previously signed agreement between Apple and OpenAI to integrate AI solutions into Apple products. According to Bloomberg, that partnership failed, leading to mutual grievances. In April 2026, analyst Ming-Chi Kuo reported that OpenAI is building its own smartphone, with a potential 2028 market entry. The io Products acquisition and hiring of former Apple engineers point to ambitious hardware plans.
This isn’t OpenAI’s first such legal battle. In September 2025, Elon Musk’s xAI sued OpenAI over poaching employees and stealing source code. In June 2026, the court dismissed that case for lack of evidence.

Over the weekend, after the Apple lawsuit was filed, Elon Musk posted on X: “Scam Altman is at it again,” playing on the OpenAI CEO’s name. He followed with several sarcastic posts accusing his rival of fraud.

The rivalry between the billionaires dates back to 2015, when Musk co-founded OpenAI with Altman but left the board in 2018. In May, the court ruled Musk had filed too late to challenge OpenAI’s shift to a for-profit model. Weeks later, SpaceX held a record $75B IPO, and OpenAI filed for its own listing–further raising the temperature.
